  • The Malaysi= a Addendum to the 3M Global Privacy Policy (Bahasa Malaysia)

    This addendum supplements, details or modifies the 3M Global P= rivacy Policy in accordance with the applicable local data privacy law, its= implementing rules and regulations and related issuances of the local data= privacy regulator (collectively referred to herein as =E2=80=9CLaw=E2=80= =9D).

    This addendum applies to the processing of personal informatio= n and sensitive personal information (collectively, =E2=80=9CPersonal Data= =E2=80=9D) by 3M Malaysia Sdn Bhd (=E2=80=9C3M=E2=80=9D or =E2=80= =9Cwe=E2=80=9D hereinafter). For this purpose, the term =E2=80=9Cprocessing= =E2=80=9D shall include, but not limited to, the collection, recording, org= anization, storage, updating or modification, retrieval, consultation, use,= consolidation, blocking, erasure or destruction of personal data.

    Personal in= formation

    Malaysia law defines personal information as any information i= n respect of commercial transactions, that relates directly or indirectly t= o a data subject, who is identified or identifiable from that information o= r from that and other information in the possession of a data user, includi= ng any sensitive personal data and expression of opinion about the data sub= ject; but does not include any information that is processed for the purpos= e of a credit reporting business carried on by a credit reporting agency un= der the Credit Reporting Agencies Act 2010.

    The personal information collected by 3M may include, but not = limited to, the following:

    • name, title, address; =
    • personal identification and/or passport number; =
    • telephone number; =
    • email address and online passwords; =
    • records of communications with 3M; =
    • responses to market surveys and contests conducted by 3M or on its beha= lf; =
    • credit card or debit card information; =
    • camera or video footage that identifies individuals (including CCTV foo= tage) installed at some parts of 3M=E2=80=99s premises as part of its secur= ity infrastructure; =

    Sensitive p= ersonal information

    a. Definition of sensitive personal information

    Under Malaysia law, sensitive personal information refers to a= ny personal data consisting of information as to the physical or mental hea= lth or condition of a data subject, his political opinions, his religious b= eliefs or other beliefs of a similar nature, the commission or alleged comm= ission by him of any offence or any other personal data as the Minister may= determine by order published in the Gazette.

    b. Processing of sensitive personal information

    We will only process sensitive personal information upon the e= xpress consent of the data subject and only for purposes it was provided, o= r in accordance with law.

    In processing sensitive personal information, 3M will inform d= ata subjects of the sensitive personal information that is necessary to ful= fill the core functionality of the product or service, and the consequences= of refusal to the processing, for the purpose of allowing the data subject= s to decide whether or not to give consent.

    Collection,= Purpose of Collection and Processing of Personal Data

    Personal data will, generally, only be collected and used for = the primary purposes of:

    • communicating with employees, customers, contractors, suppliers, agents= or any other individuals; =
    • conducting, improving, maintaining and developing a business relationsh= ip and/or for employment purposes; =
    • general HR administration and information required for the management o= f the employment relationship; =
    • processing, servicing or enforcing transactions and sending related com= munications; =
    • identifying and verifying individuals that have been supplied with any = 3M services or products; =
    • administering customer orders or managing projects; =

    3M does not disclose your personal data for any secondary purp= oses unless your consent has been previously obtained in accordance with la= w.

    3M will not sell or license any personal data that it collects= from an individual.

    In situations where 3M processes personal data outside reasona= ble expectations, 3M will require your consent prior to processing.

    Cross-borde= r disclosure

    Any personal data provided to 3M may be transferred to, stored= by or disclosed to an overseas recipient. For example, 3M may use a server= hosted overseas to store data, which may include your personal data.
